Belgium: Green light for B2B eInvoicing legislation
There is significant news for companies operating in Belgium. In early January 2024, the Belgian Federal Parliament gave the green light to mandatory B2B e-invoicing legislation. Belgium intends to introduce mandatory electronic invoicing in the B2B sector starting January 1, 2026. The corresponding draft bill was submitted to the Chamber of Representatives in early January 2024. At the same time, the government is seeking an exemption from the EU Council to deviate from the current provisions of the VAT System Directive (VAT System Directive). This is nothing unusual, as Italy, Poland, France, Hungary, and most recently even Germany have already had to take this route to advance mandatory e-invoicing at the national level.
However, any resulting confusion—particularly regarding international transactions and invoicing—is not an issue for customers of the TRAFFIQX provider network: they benefit from the consistent implementation of all current and country-specific regulations.
Who is affected by the Belgian eInvoicing Act?
Companies headquartered in Belgium, as well as foreign firms with a VAT establishment in Belgium, will be required to issue e-invoices. Similarly, recipients of services not established in Belgium are expected to be required to accept electronic invoices for services provided in Belgium. The introduction of a reporting obligation is planned for a later stage.
What happens next?
The proposed legislation is now on its way to the Belgian King for signature and will soon be published as a decree in the Official Gazette.
You should mark the date on your calendar now: The Belgian B2B e-invoicing requirement is set to take effect on January 1, 2026, provided the country receives the hoped-for exemption from the EU VAT Directive. The application for this was already submitted in October 2023.
